Terms of Service

1. Acceptance of Terms

By accessing and using Prep360 ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service apply to all users of the Service, including without limitation users who are browsers, students, parents, guardians, or contributors of content.

2. Description of Service

Prep360 is an online educational platform designed to help Junior High School (JHS) students in Ghana prepare for the Basic Education Certificate Examination (BECE). The Service provides:

• Access to thousands of practice questions across all BECE subjects
• Interactive learning modules and study materials
• Progress tracking and analytics
• Personalized learning paths and recommendations
• AI-powered insights and feedback
• Weekly progress reports sent to guardians

3. User Accounts and Responsibilities

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and identification
• Accept all responsibility for activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3.2 Guardian Information

For users under 18 years of age, a parent or guardian must provide their information during registration. Guardians will receive weekly progress reports and must consent to the use of the Service by the student.

4. Subscription and Payment Terms

Access to certain features of Prep360 requires a paid subscription. By subscribing, you agree to:

• Pay all fees associated with your subscription as described on the Service
• Automatic renewal of your subscription unless cancelled
• Payment processing through our third-party payment provider (Paystack)
• No refunds for partial subscription periods, except as required by law

We reserve the right to change our subscription fees at any time. We will provide notice of any fee changes at least 30 days in advance.

5. Intellectual Property Rights

All content on Prep360, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Prep360 or its content suppliers and is protected by Ghanaian and international copyright laws.

You may not:

• Reproduce, distribute, or create derivative works from any content without written permission
• Use any content for commercial purposes
• Remove any copyright or proprietary notices from content
• Share your account credentials with others

6. Prohibited Uses

You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
• To impersonate or attempt to impersonate Prep360, a Prep360 employee, another user, or any other person or entity
• In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful
• To engage in any automated use of the system, such as using scripts to send comments or messages
• To interfere with, disrupt, or create an undue burden on the Service or the networks or services connected to the Service

7. Limitation of Liability

To the fullest extent permitted by applicable law, Prep360 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service
• Any conduct or content of third parties on the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service

Prep360 does not guarantee that the Service will be available at all times or that it will be error-free. The Service is provided "as is" and "as available" without warranties of any kind.

8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

10. Governing Law

These Terms shall be interpreted and governed by the laws of the Republic of Ghana, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ghana.
